Based
on a social contract between the people as legislator on one hand, and the ruler
as executor on the other.
The
main difference between AL-Bia’a
and Democracy are:
·
Democracy
is just a contract of between people and
ruler.
·
AL-Bia’a
is based on the complementarity between the performance inseparable contracts:
A
- The belief contract is: a divine contract between people(both ruler and ruled
) and Allah Almighty, whereby people commit
themselves to carry into effect The Sharia
and to abide by his regime .
B - The contract of the
performance is: a social contract between people and ruler to cooperate for
implementation of the will of Allah Almighty according to His divine guided
system.
C
– The integration and the complementarity between the belief contract and the
contract of the performance would entail the following:
1.
Allah Almighty is the One and Only source of legislation.
2.
People of the specialization and religious scholars have to legislate and
develop the new principles which the people‘s interests request throw the
time.
3.
Both ruler and people are accountable before Allah, being responsible to
carry into effect His regime, according to the belief contract.
4.
Both ruler and people are responsible one before the other to implement,
and abide, by Islamic law.
5.
There are neither contradiction nor conflict of interests between ruler
and people in Islam, but there is rather a mutual guidance between them to work
together to do their best in order to achieve their common interests.
6.
Both ruler and people are required to find out solutions for new issues
and events, within the fixed rules of the Sharia ( Islamic law).
